The website yoga360.ca (the “Website”), and the services offered from the Website (collective, the “Service”) are owned and operated by Yoga 360 Inc. and its corporate affiliates (collectively, “Yoga 360,” “we,” “us,” and “our”). This Privacy Policy (this “Policy”) describes how we collect, use, disclose and protect the personal information of our guests and members, Website users and app users (“you”) and the types of information we may collect form you.

Privacy laws in Canada generally define “personal information” as any information about an identifiable individual, which includes information that can be used on its own or with other information to identify, contact, or locate a single person. Personal information does not include business contact information (e.g. your name, title, or business contact information).

CONSENT

BY SUBMITTING PERSONAL INFORMATION TO Yoga 360, YOU AGREE THAT YYOGA MAY COLLECT YOUR PERSONAL INFORMATION AND YOU CONSENT TO THE USE, DISCLOSURE AND TRANSFER OF YOUR PERSONAL INFORMATION IN ACCORDANCE WITH THIS POLICY AND AS PERMITTED OR REQUIRED BY LAW. Subject to legal and contractual requirements, you may refuse or withdraw your consent to certain of the purposes identified herein at any time by contacting Yoga 360 at the address provided at the end of this Policy. If you refuse or withdraw your consent, you acknowledge that Yoga 360 may not be able to provide you or continue to provide you with certain services or information, which may be of value to you.

We use different methods to collect your information including through direct interactions with you when you provide it to us, including through: (1) direct interactions with you, for example, by registering an account with us or corresponding with us by phone, email, or otherwise; (2) your contribution where you provide information for us to publish or display on our Website or apps or transmit to other Service users or third parties; (3) automated technologies or interactions, as you navigate through our Service; and (4) third parties or publicly available sources, for example, our business partners.  Each of these methods are explained in more details below.

Registration and Data Collected Automatically

Registration:

We collect information directly from you when you register an account with us.  Registration is required before certain Website features can be used such as online class reservations and online purchasing. Forms request your contact information (name, email address, mailing address, postal code etc.), demographic information (country, gender, etc.), and profile data. An email address and a password are required to operate our digital systems. We use this to communicate with you and provide a personalized experience.

With your permission, we may access certain personal information on your device, such as your phone book, calendar or messages, in order to provide Services to you. In registering for an account with us, you may be provided with an option to link your social media login information and password through platforms such as Facebook, Twitter, Instagram, or similar. If you do so, you authorize us to access certain social media account information (consistent with your social media privacy settings), including but not limited to your profile information, username, email address and physical address. All such information is provided directly by the social media platform, whose use of your personal information will be subject to its own privacy policy and terms of use.

Without registering an account with us, we may still collect personal information such as your name, address, phone number or email address if you provide such information to us directly. We will use this information to fulfil the purpose for it was collected, for example, to inform you about our products and services or to book classes, or as required by law.

Automated Technologies:

In order to improve performance, give you a personalized experience and better understand how our websites and apps function for you, we use technologies like cookies (small files stored on your browser), web beacons (small electronic files that collect website statistics), pixel tags (a method for passing information from the user’s computer to a third party website), eTags, JavaScript, or unique device identifiers to (a) identify your computer or device, (b) learn about your visits to, and interaction and engagement with the Services and Yoga 360 social media channels, and (c) learn about your interaction with emails including the emails including the content and ads (collectively, “Online Data”), so we can estimate our audience size and usage patterns and deliver a better experience to you including without limitation allowing us to customize our Website or apps according to your individual interests, speed up your searches and/or recognize you when you return to our Website. Our systems also log information like your browser, operating system and IP address.

You may refuse to accept browser cookies by activating the appropriate setting on your browser. However, if you select this setting you may be unable to access certain parts of our Website. Unless you have adjusted your browser setting so that it will refuse cookies, our system will issue cookies when you direct your browser to our Website.

Communication between You and Yoga 360

When you contact us, we retain your email and contact information to serve you best. We may offer features where you can send information to others. We will use the contact information you enter so your friends will know whom the message is coming from.  We may have contests and/or surveys on our Website or application. When you participate, we may request contact information (name, email address, mailing address, telephone number, demographic, and profile information). We use the information to conduct the promotion (for example, to contact you if you are the winner). We may partner with sponsors to offer contests or surveys, and may share your information with them so they can contact the winners and/or participants.

DISCLOSURE AND TRANSFER

We may disclose your personal information as follows:

  • To our affiliates.
  • In accordance with applicable law, to a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by Yoga 360 about our users is among the assets transferred.
  • To contractors, service providers, and other third parties we use to support our business (such as analytics and search engine providers that assist us with Website or application improvement and optimization) and who are contractually obligated to keep personal information confidential, use it only for the purposes for which we disclose it to them, and to process the personal information with the same standards set out in this Policy.

  • To comply with any court order, law, or legal process, including to respond to any government or regulatory request, in accordance with applicable law.
  • To enforce or apply our Terms of Services and other agreements that we have with you, including for billing and collection purposes.

We may disclose aggregated information about you and information that does not identify any individual for marketing purposes and industry report without restriction.

Except as otherwise specified in this Policy, we generally do not share personal information with other companies without your expressed consent.

We may process, store, and transfer your personal information in and to a country outside of Canada, with different privacy laws that may or may not be as comprehensive as Canadian law. In these circumstances, the governments, courts, law enforcement, or regulatory agencies of that country may be able to obtain access to your personal information through the laws of the foreign country. Whenever we engage a service provider, we require that its privacy and security standards adhere to this Policy and applicable Canadian privacy legislation.

YOUR RIGHTS, RETENTION AND SECURITY

Access and Correction:

You can sign into your account to see most of the personal information we hold about you, such as your name, email, address or phone number. It is important that the personal information we hold about you is accurate and current. Please keep us informed if your personal information changes.

We may charge you a fee to access your personal information, however, we will notify you of any fee in advance. Data Retention:

Except as otherwise permitted or required by applicable law or regulation, we will only retain your personal information for as long as necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements. Under some circumstances we may anonymize your personal information so that it can no longer be associated with you. We reserve the right to use such anonymous and de-identified data for any legitimate business purpose without further notice to you or your consent.

Security:

We take reasonable administrative, physical and electronic measures designed to safeguard and protect your information from unauthorized access   or disclosure. This includes utilizing Secure Sockets Layer (SSL) software, which encrypts the personal information you input, and storing your information in encrypted form behind a firewall designed to block access from outside our network.

The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Service, you are responsible for keeping this password confidential. We ask you not to share your password with anyone. We urge you to be careful about giving out information in public areas of the Service, which any Service user can view.

Unfortunately, the transmission of information via the Internet is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted to our Website or application. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Website or our application.

Children under The Age of 13:

Our Service is not intended for children under 13 years of age. We do not knowingly contact or collect personal information from children under 13. If you believe we have inadvertently collected such information, please contact us so we can promptly obtain parental consent or remove the information.

This Policy was last updated on August 24, 2022. Our Policy may change from time to time. If we make any material changes to our Policy, we will place a prominent notice on our Website or application and we may send a notice to registered users by email if such material changes affect the registered users.
